Belle’s Boarding and Bath, LLC Client Agreement

As a general overview, Belle’s Boarding and Bath, LLC, a California limited liability company (referred to herein as “Belle’s”, “we” or “our”) Services (as defined below) are designed for social dogs to experience balanced play and socialization. Safety is our primary goal; therefore, we may not be suitable for every dog. It is not a place for aggressive dogs to learn how to be social. As set forth more thoroughly in this Client Agreement (“Agreement”) and on our website at http://bellesboarding.com, to participate in the Services, each dog / owner (as applicable) must:

Complete an online portal.
Meet our vaccination and temperament standards.
Be spayed or neutered.
Have a negative fecal test from the past 60 days.
Wear a collar (or purchase one from us) and be on a leash upon entry and departure.
Play well and gently with other dogs, show no aggression, and be able to enjoy the open play

environment.
Not be an excessive barker.
Be at least four months old.
Be free of fleas/ticks.
Be microchipped.

This Agreement is entered into by and between and the individual indicating their assent to these terms (“I,” “me,” “myself”), as of the date of such assent (the “Effective Date”). Belle’s and the undersigned individual are referred to herein individually as a “Party” and collectively as the “Parties.” As such, the undersigned agrees as follows:

I understand that to ensure the safety of my Dog identified in the enrollment form submitted through Belle’s online platform (my “Dog”), I must provide written authorization for anyone else picking up my Dog. The pickup person must present a photo ID prior to my Dog being released.
I specifically represent to Belle’s that I am the legal owner of my Dog , and that any and all known allergies, other sensitivities or health conditions have been properly disclosed. In addition, my Dog is healthy, meets Belle’s vaccination standards, has not harmed or shown aggression or threatening behavior towards any person(s) or other dog(s), which may include, but is not limited to, growling, forceful barking, snapping, raising of hackles, lowering of head and staring, chasing, attempting to bite/lunging, and biting, and has not been exposed to any known communicable disease within the 30-day period immediately prior to admission for Services, such as kennel cough, giardia, canine influenza, parasitic worms, or conjunctivitis. I further indicate that each time my Dog is brought to Belle’s, I will be recertifying that my Dog is in good health and has not had any communicable illness of any kind for 30 days prior to admission. I further agree to inform Belle’s of any changes in my Dog’s condition and/or behavior prior to any Service being provided by Belle’s, including, but not limited to, any daycare visit, overnight boarding stay, grooming, training, wellness services, food counseling, and self- service washes or other service (collectively the “Services”).
I understand and agree to complete any documentation required by Belle’s in order to request and receive any Services, via Belle’s online portal or another method as instructed by Belle’s.

In consideration for Belle’s Services, I understand that I shall pay Belle’s the rate applicable to the

Services provided, based on the schedule of rates found on our website at http://bellesboarding.com. Payment shall be made at the time I pick up my Dog via ACH transfer, cash, or card. To the extent permitted by law, I hereby authorize Belle’s to initiate a credit card charge, using the information provided and on file with Belle’s, for any outstanding balances, such as for rendered Services and/or any other applicable fees. If my card on file is declined or I have no card on file, payments will incur a $5.00 per day late fee until payment is received.
I understand that my Dog must be spayed or neutered prior to attending daycare .
I represent and warrant that my Dog is fit and healthy to take part in any activities and Services while at Belle’s and is capable of play and exercise with other dogs, unless I have made Belle’s aware. In addition, I acknowledge that I am not permitted to bring personal play items to Belle’s

(e.g., balls, toys, beds).
I understand daycare Services are offered between 7 A.M. – 7 P.M. Dogs not picked up by

closing time (7 P.M.) will be charged $10.00 for every 15 minutes after 7 P.M.
I agree that if my Dog is not picked up by the end of the regular business day, then I hereby

expressly authorize Belle’s to take whatever action is deemed necessary for the continuing care of my Dog. I further agree and promise to pay Belle’s for all costs of continuing such care. Further, I understand that if I do not pick up my Dog for a period of 14 calendar days, Belle’s shall be authorized to proceed according to California Civil Code § 1834.5, which provides as follows:

“Notwithstanding any other provision of law, whenever an animal is delivered to a veterinarian, dog kennel, cat kennel, pet-grooming parlor, animal hospital, or any other animal care facility pursuant to a written or oral agreement entered into after the effective date of this section, and the owner of the animal does not pick up the animal within 14 calendar days after the day the animal was initially due to be picked up, the animal shall be deemed to be abandoned. The person into whose custody the animal was placed for care shall first try for a period of not less than 10 days to find a new owner for the animal or turn the animal over to a public animal control agency or shelter, society for the prevention of cruelty to animals shelter, humane society shelter, or nonprofit animal rescue group, provided that the shelter or rescue group has been contacted and has agreed to take the animal. If unable to place the animal with a new owner, shelter, or rescue group, the animal care facility may have the abandoned animal euthanized.”
I understand that my Dog is required to be fully vaccinated (including distemper/parvo (DHPP), rabies, and bordetella), and I will provide Belle’s with proof thereof from a licensed veterinarian prior to the provision of any Services. I agree to provide Belle’s with annual updates of my Dog’s vaccination records. I acknowledge that it is my responsibility to ensure that my Dog continues to be fully vaccinated, and that Belle’s reserves the right to remove my Dog from the Facility, located at 5751 W. Pico Blvd., Los Angeles, CA 90019 (“Facility”) if Belle’s learns my Dog is not fully vaccinated and/or such vaccination records are not received timely upon request. I acknowledge and am aware that the employees of Belle’s are not veterinarians, do not have backgrounds in animal medicine, and are not expected to diagnose, treat, or detect illnesses in the dogs that are staying at Belle’s Facility. In addition, I acknowledge and am aware that vaccines do not protect against all illnesses that may affect dogs.
I understand that even though my Dog is vaccinated for Kennel Cough, there is a chance that Kennel Cough can still be contracted. I agree that I will NOT hold Belle’s responsible if my Dog contracts Kennel Cough. I understand that the Kennel Cough vaccine must have been

administered at least 5 days prior to my Dog entering daycare. If my Dog is showing symptoms of Kennel Cough or is suspected to have Kennel Cough, Belle’s will notify me as soon as reasonably practical and return the Dog home as soon as they are able to do so.

I understand that my Dog must have flea protection. I acknowledge that flea collars are not acceptable. I understand that my Dog will be inspected for fleas when entering Belle’s, and will be refused entrance to the Facility if fleas are found. I understand that if my Dog is refused entrance, Belle’s shall have discretion to collect full payment for the scheduled Service. I further acknowledge that Belle’s shall not be held responsible if my Dog contracts fleas while at Belle’s because proper flea protection is my responsibility.
Any medication that is to be administered by Belle’s staff must come with instructions and proper storage information. Side effects must be discussed prior to administering.
I understand that the play environment at Belle’s provides dogs the opportunity to play in close physical contact, including with their teeth and paws. I acknowledge that no amount of supervision or personalized care by Belle’s, its agents, or employees can prevent the possibility of injury or illness to my Dog. I acknowledge that Belle’s and its employees make all reasonable efforts to notice any nicks or scratches that may occur and grant Belle’s and its employees full authority to make decisions involving first aid treatment of my Dog while at Belle’s, which may involve cutting/clipping of hair and wound care and treatment.
- ○ I understand that in an emergency, Belle’s will attempt to contact me and my Dog's personal veterinarian; however, such an emergency might not provide the time to do so prior to the administration of care. I authorize Belle’s to obtain medical attention for my Dog from any licensed veterinarian and to transport my Dog to and from such a veterinarian when Belle’s deems such medical care is important to the Dog’s health. I grant Belle’s and its employees or agents full authority, in their sole discretion, to make decisions involving the medical treatment of my Dog and agree to pay for all related costs. This applies to any claims for death, injuries, or damages related to such medical care or that arise due to the transport of the Dog. In the event of a Dog’s death, myself or my emergency contact will be notified immediately.
- ○ I agree to have appropriate insurance to cover my Dog’s personal injury in the unlikely event of an incident; alternatively, I agree to cover any costs relating to accidents that may occur at Belle’s which result in injury to my Dog. Belle’s strongly advises to insure your Dog for all eventualities.
I understand that daycare at Belle’s is a kenneled and free-roam service and, as set forth above, that the Services involve inherent risk. These inherent risks include, but are not limited to, dangers of serious physical injury or death to my dog or myself and property damage resulting from, but not limited to: physical exercise and exertion; physical contact with other pets, owners, and/or Belle’s staff or vendors; injury due to environmental hazards, uneven surfaces, equipment malfunctions, or debris; health hazards related to communicable illnesses or conditions of other pets; other health hazards associated with physical activity and outdoor play; transportation; the risk of my Dog escaping or running away from Belle’s staff and/or Belle’s Facility; and hazards related to eating, including choking and allergic reactions (collectively the “Injuries and Damages”). I further acknowledge and understand that these Injuries and Damages cannot be entirely eliminated. I fully understand and agree that Belle’s has not tried to contradict or minimize my understanding of these risks. I understand that Injuries and Damages can occur by natural causes or activities of other dogs, environmental circumstances, staff of Belle’s or other third parties, either as a result of negligence or because of other reasons. I understand that other dogs cannot necessarily be controlled at all times, and that myself and my Dog’s safety, physical health, or emotional wellbeing cannot be guaranteed while participating in the Services or visiting the Facility.

In acknowledging the foregoing section related to assumption of risk, I CONFIRM MY UNDERSTANDING OF THE FOLLOWING: To the fullest extent allowed by law, I agree to WAIVE AND DISCHARGE CLAIMS AGAINST AND RELEASE FROM LIABILITY Belle’s and its parents, subsidiaries, related entities, and affiliates and their respective past and present members, managers, officers, partners, agents, representatives, attorneys and employees (collectively “Released Parties”) from and against ANY AND ALL LIABILITY on account of, or in any way resulting from, the Services or Injuries or Damages resulting from my Dog’s participation in the Services, or transportation or provision of medical services to my Dog, even if caused by NEGLIGENCE of the Released Parties; such negligence could involve negligent verification of any dog’s vaccinations or history of behavioral issues. I understand and intend that the assumption of risk and release is binding upon my heirs, executors, administrators and assignors. This waiver and release is intended to be as broad and inclusive as is permitted by law. I further acknowledge and agree that under no circumstances will Belle’s be liable for indirect, special, punitive, or consequential damages arising from the Services or any Injuries and Damages to myself or my Dog.
I agree, on behalf of myself, my successors, assigns, and heirs, not to sue the Released Parties or initiate or assist in the prosecution of any claim for damages or cause of action against the Released Parties which I or my heirs may have as a result of any personal injury, death, or property damage my Dog or myself may sustain while participating in the Services or entering into the Facility.
I represent and warrant that my Dog will be kept on a lead/leash at all times on walks away from Belle’s unless I have given specific consent to allow my Dog to be let off-lead.
I agree to indemnify, defend, and hold harmless Belle’s, along with its members, managers, officers, employees, agents, affiliates, and representatives, from any liability, loss, expense, cost, or damage of whatever kind or nature (including without limitation, reasonable attorneys’ fees and expenses and other litigation expenses), arising from the Services or myself or my Dog’s admission to the Facility. This includes, but is not limited to, any losses or damages sustained as a result of my negligence, or failure to disclose any pre-existing conditions my Dog may have (such as illness or aggression), or any bites, injuries, or damages caused by my Dog. I understand Belle’s reserves the right to refuse admittance to the Facility to any dog that displays signs of untreated or potentially contagious conditions, demonstrates aggressive behavior, or fails our standard health and temperament policies (contained in our client intake form) or for any other reason. I further understand and agree that any problems that develop with my Dog will be treated as deemed appropriate by the staff of Belle’s, in their sole discretion.
I hereby give Belle’s permission to use, reproduce, distribute, or publish any photographs, films, videotapes, audio and video recordings, electronic representations and/or sound (“Media”) taken of my Dog, including for use on our website and/or social media pages. I understand and agree that Belle’s shall be the sole owner of any such Media, and releases Belle’s from any and all liability resulting from such use, reproduction, distribution, and publication and authorizes the reproduction, sale, distribution, copyright, exhibit, broadcast, and/or electronic storage of any and all such Media without limitation at the discretion of Belle’s. Additionally, I specifically waive any right to any compensation for any of the foregoing.
I hereby give Belle’s permission to hold my personal details provided on registration in their online database, and I understand no other person has access to my data with the exception of Belle’s staff. This information will not be passed on or shared with any other third party without my prior consent.
I understand that Belle’s requires no less than 48 hours' notice of any cancellations in order to be fully refunded for my scheduled Service.

In the event any provision of this Agreement is declared by a court of competent jurisdiction to be unenforceable, the remaining provisions shall remain in full force and effect.
Belle’s reserves the right to terminate this Agreement at any time and for any reason. In the event of my material breach of this Agreement, Belle’s shall be entitled to keep any payment received as a result of such material breach.
I acknowledge and agree that Belle’s makes no representation as to the condition of the Facility or the safety of the Services or any equipment either at the Facility or used in the Services, if any.
This Agreement shall be governed by the laws of the State of California, without reference to rules regarding conflicts of law. Any legal suit, action or proceeding arising out of or related to this Agreement shall be instituted in the federal courts of the United States or the courts of the State of California in each case located in Los Angeles County and each Party irrevocably submits to the exclusive jurisdiction of such courts in any such suit, action or proceeding.
By reading this Agreement and leaving my Dog with Belle’s, I certify the accuracy of all information provided to Belle’s in writing and orally about the Dog.

I HEREBY ACKNOWLEDGE THAT I HAVE FULLY READ AND UNDERSTAND EACH OF THE ABOVE PROVISIONS AND THAT I AM GIVING UP SIGNIFICANT LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE BELLE’S. I ACKNOWLEDGE THAT PRIOR TO CONTINUING WITH THIS AGREEMENT I HAD THE OPPORTUNITY TO CONSULT WITH AN ATTORNEY TO REVIEW THIS AGREEMENT. I FURTHER ACKNOWLEDGE THAT I AM AT LEAST EIGHTEEN (18) YEARS OF AGE AND FULLY COMPETENT AND EXECUTE THIS AGREEMENT VOLUNTARILY AND FOR ADEQUATE CONSIDERATION INTENDING TO BE FULLY BOUND.
